Here you will find all legal regulations and information for the use of the Believa B2B online shop.

§ 1 General

These General Terms and Conditions (GTC) apply to all contracts concluded between believa GmbH and consumers via the online shop on the website www.believa.de . The version valid at the time of contract conclusion shall apply. The contract language is German.

§ 2 Order and Conclusion of Contract

We offer consumers the opportunity to order goods electronically via our online shop. An order becomes binding when the customer activates the “BUY NOW” button at the end of the order process in the “Review and Pay” section. Before submitting the order, the entered data and the shopping cart can be changed at any time. The order constitutes a binding offer by the customer to conclude a purchase contract. BELIEVA GmbH will usually confirm receipt of the order by sending an automatic order confirmation via email; however, this does not yet constitute acceptance of the offer. Acceptance of the contract takes place upon sending the shipping confirmation by email or, at the latest, upon dispatch of the ordered goods. Order data and the GTC will be sent to you via email. Orders can only be accepted from customers who are at least 18 years old. All products are sold only in quantities customary for household use. This applies both to the number of products ordered within a single order and to multiple orders of the same product.

§ 3 Delivery

Delivery is made to the address provided by the customer or to a DHL Packstation. Delivery is only available within EU member states. For orders with a value of up to €50.00, a flat shipping fee of €3.95 is charged. Orders over €50.00 are shipped free of charge. Shipping takes place within 1–2 working days after payment has been received, provided the item is marked as “available” in the online shop. Shipping is generally carried out via DHL.

§ 4 Prices

All prices stated on www.believa.de include the applicable statutory VAT. Packaging and shipping costs are not included in the price and will be charged separately (see Delivery).

§ 5 Payment Terms

Delivery of the goods ordered by the consumer will only be made against advance payment. The buyer is obliged to pay for the ordered goods immediately after submitting the offer. If payment is not received, no contract is concluded. Goods will only be shipped after payment has been received by BELIEVA GmbH. Various payment methods are available in the online shop.

§ 6 Right of Withdrawal for Consumers

Consumers are entitled to a right of withdrawal in accordance with the following cancellation policy.Widerrufsrecht

The right of withdrawal pursuant to § 6 applies exclusively to consumers, not to businesses.

§ 7 Warranty, Liability

Warranty claims are governed by the provisions of the German Civil Code (BGB), unless otherwise stated below. If the customer is a business, the delivered goods must be inspected immediately upon receipt for quality and quantity deviations. Any recognizable defects must be reported in writing within one week of receipt; otherwise, warranty claims are excluded. Deviations of goods from descriptions or images do not constitute claims by the buyer. Descriptions and information do not constitute guarantees in the legal sense. Defects must be reported immediately, but no later than one week after discovery. In the event of justified defects, we will, at our discretion, either repair the goods free of charge or provide a replacement. Repeated repairs are permitted. Warranty claims are only available to the direct buyer. In all cases where we are liable for damages, we are only liable in cases of intent or gross negligence.
